Thanks for being part of our alpha testing phase. We're really glad you're here - your feedback helps us build something great. These terms are intentionally short and straightforward. Please do read them. By using Marker, you agree to these terms.
1. About us. We are Letter Assembly Ltd. We are a company registered in England and Wales under company number 16291760 and our registered office is at 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ.
When we refer to 'we', 'us' or 'our', we mean Letter Assembly. When we refer to 'you' or 'your' we mean you, the person using Marker.
2. What you're signing up for. You're getting early access to Marker, a writing tool that's still in active development. That means things may break, change, or disappear entirely (though we really hope not!). We'll do our best to keep things running, but we can't promise a polished experience just yet. 3. Who can use it. You need to be at least 18 years old and have been invited to take part in the alpha testing phase.
4. Your account. To use Marker, you'll need to create an account with your email address or use third-party sign in. Your account is yours, so please keep your login secure. You're responsible for anything that happens under your account, including all the brilliant writing you do.
5. Your writing. Anything you write or upload using Marker belongs to you. We don't claim any rights over your creations. That said, we do need limited permission to store and process your writing so Marker actually works.
6. Access to documents. Documents are private by default, and you control who you share them with. For pre-defined purposes – like investigating technical issues, providing support, or complying with legal obligations – Marker staff may access a document. We will only do so when absolutely necessary.
7. How Marker's AI works.
What Marker does: When you work on a document, Marker's AI analyses that document to understand its characteristics, such as the intended audience, genre, form, and tone. For example, if you're writing a formal letter, Marker detects this and tailors its suggestions to match formal conventions. These characteristics are used only to provide more relevant interactions. Marker also keeps a conversation history when you interact with the AI assistant.
Other models we use: While we use some third-party models (like Claude), we specifically configure our usage so none of your data is used to train their models. Your writing is never used for their model training.
8. Feedback. If you share feedback, ideas, or bug reports with us - and we really hope you do - we may use that to improve our products and services (and you'll be rewarded with our everlasting appreciation!).
9. What we ask of you. This section explains what we expect from you as a user. If your conduct falls below this standard, or if there are other legitimate reasons, we may suspend or end your access to Marker.
Please use Marker responsibly and in good faith. You should not use Marker to do anything illegal, harmful, or that you wouldn't be comfortable explaining to us. The following are off limits:
Your conduct: (a) doing anything illegal, harmful, or abusive, including harassing, threatening, or impersonating others; or (b) using Marker to generate or distribute content that is unlawful, defamatory, or discriminatory.
Our technology: (a) copying, modifying, reverse engineering, decompiling, or creating derivative works based on Marker or any part of it; (b) scraping, crawling, or otherwise extracting data or content from Marker using automated tools or scripts; (c) uploading or introducing any viruses, malware, or other harmful code that could damage or interfere with Marker or anyone else's use of it; (d) attempting to gain unauthorised access to any part of Marker, our systems, or other users' accounts; (e) interfering with or disrupting the security, integrity, or performance of the service; or (f) reproducing or distributing any part of Marker's interface, content, or documentation without our consent.
10. Our intellectual property. Marker and everything that makes it work (including the software, design, and underlying technology) belongs to us or our licensors. Using Marker does not give you any rights to any of this except that we grant you limited, non-exclusive, non-transferable, revocable permission to access and use Marker solely for the purposes set out in these terms. This licence can be withdrawn at any time, for example, if you breach these terms.
11. Privacy. We collect and process some of your personal data to run and improve Marker. Please read our Privacy Notice to understand what we collect and how we use it.
12. Updates. Because Marker is in its alpha phase, we may need to: (a) suspend Marker at any time for maintenance or updates; (b) change features, remove them, or add new ones without notice – including adding usage or storage limits; or (c) end the alpha phase at any time and without warning. We'll try to give you a heads up where we reasonably can. We may also introduce charges for access to Marker or certain features, in which case we will notify you in advance and give you the option to stop using Marker if you do not wish to pay.
13. Liability. We're providing Marker to you free of charge during the alpha phase, so we need to be upfront: Marker is provided "as is". To the fullest extent permitted by law, we are not liable for anything arising out of or in connection with your use of Marker, including loss of data, loss of business, or indirect, special, or consequential loss. Nothing in these terms affects your statutory rights, or limits liability for anything that can't be limited by law (such as fraud, or death or personal injury caused by our negligence).
14. Ending your access to Marker. You can stop using Marker at any time (though our hope is you love it and keep using it in the future!).
If your account is closed, we'll hold onto your writing for a reasonable period of time and then delete it — unless we're legally required to keep it for longer.
15. Transfers. We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights.
16. Changes to these terms. We may update these terms from time to time, for example, as Marker evolves or to reflect any legal or regulatory changes. If we make any changes, we'll let you know by email or by displaying a notice within Marker before the changes take effect. Your continued use of Marker after that point means you're happy with the updated terms. If you're not happy with the changes, you can stop using Marker and contact us using the details below.
17. Governing law. Subject to the remainder of this clause, these terms are governed by the laws of England and Wales and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. If you live in Scotland, you can bring legal proceedings in either the Scottish or the English courts. If you live in Northern Ireland, you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
